Nick Lacey's attempts to stop the publication of X-rated pics of him and lover Vanessa Minnillo have failed.
A Spanish magazine has printed the shots of Nick, 33, having sex in a hot tub with girlfriend Vanessa, 26.
The couple had hired Hollywood lawyer Marty Singer to prevent the explicit images from surfacing, reports The Sun - but now Hollywood gossip fans in Barcelona and Bilbao are lapping them up.
Pictures of the couple snogging in a Jacuzzi at a private Mexican resort have already been published as well as censored nudes in a US magazine.

Nicole Richie and Joel Madden are believed to be engaged.
A local radio DJ announced the happy news after the Good Charlotte frontman performed with his band at the Hot 99.5 Lil' Black Dress Party at Virginia's Clarendon Ballroom on Friday (17.08.07).
Hot 99.5 morning show host Kane came onto the stage following the acoustic show and shouted to the crowd: "He got engaged yesterday. Congratulations, Joel!"
Joel - who is expecting his first child with Nicole - did not say anything but waved to the audience before making a hurried exit.
Kane revealed: "I offered my personal congratulations to Joel earlier in the night. He said, 'Thank you so much.'
"They're very excited about the baby and the wedding, but they want to keep their personal life personal."
Last week, Joel let slip his plans to pop the question to Nicole - who is four months pregnant - during an interview on US TV show 'Live!' when host Regis Philbin questioned him about his love life.
Regis said: "I hear you're going to present Nicole with a little engagement ring or something?"
Joel, who was on stage with his band ready to perform, replied: "Well I had been hoping it would be a surprise but I guess it's not now."

Ahead of her song Everything Is Wonderful she said, "This next one is about people who are awkward on the train, U.S. immigration officials and George Bush in general."
She continued, "Who else can f**k off? People who edit fashion magazines...that makes us ladies feel awful. We're all beautiful - it's the heroin addict models who've got the problem."

"You have both demonstrated to me extraordinarily good judgment in resolving this matter as you did," state Supreme Court Justice Robert A. Ross told LiLo's parents, happy that the elder Lohans avoided a public trial.
"I wish Dina the best and I hope we can both move forward and put our best foot forward for the kids' sake and just be good parents," Michael Lohan told reporters outside the courthouse. Dina said, "Now the healing process can begin for my children and myself."
The terms of the agreement were not disclosed.

The prodigy in question, Nathaniel Ayers, started showing symptoms of the disease during his second season at Julliard, and ended up on the streets of Los Angeles, where he plays violin and cello for passersby under what he believes to be the protection of the spirit of Beethoven. Ayers got the public's attention through the work of an LA Times reporter named Steve Lopez, whose columns (and upcoming book) formed part of the basis for the movie's script -- which was written, according to Variety, by Erin Brockovich screenwriter Susannah Grant.
The article also mentions that the film will be directed by Joe Wright, previously known for directing the Keira Knightley projects Pride & Prejudice and Atonement. Foxx is already studying stringed instruments under the direction of a cellist from the L.A. Philharmonic. The star, who will turn 40 in December, will need to undergo a bit of a transformation to play a second-year Julliard student, as well as that same student more than 30 years later, but he's certainly got the dramatic chops to pull it off.

It's adult."
